Terminating the employment of someone who works for you is never easy. In almost every situation, an employee doesn’t welcome the prospect of losing their job.

To support your clients through the employment termination process, it's imperative you to understand employee entitlements and employer obligations as set out in the Fair Work Act 2009 (Cth) (FWA) and other relevant legislation.

This course provides a brief overview of the employment relationship and the fundamental aspects of the FWA, particularly in relation to termination of employment. 

At the end of this course, you’ll be able to:

  • Know the legal framework for dismissal applications 
  • Distinguish between an employee and an independent contractor 
  • Identify the process for making an application 
  • Examine common situations against the legislation including whether workplace discrimination exists against a set of facts and when general protections apply
  • Consider options for settlement and/or enforcement of a claim
